Authorisation to open a private health facility

Opening a private surgery, clinic or polyclinic requires an authorisation from the ministry of health. The application is assessed after the premises have been visited by a panel of professionals from outside the administration, who report criterion by criterion. The decision remains the administration’s.

What it allows

To receive patients and to provide, on the authorised premises, the care activities named on the authorisation, up to the authorised bed capacity.

Who may apply

A health professional registered with their council, or a legal entity whose technical director is a health professional registered with their council and practising in the facility.

    This certificate is about fitness to practise and nothing else. It is never published, and it is kept under its own retention period rather than with the rest of the file.

  • Clinical waste disposal contract

    Disposing of care waste is a matter of public hygiene, which the Code de la santé publique makes an obligation of whoever runs the establishment — the arrêté sets only how it is done.

Before you start

  • The exact location of the premises — you may type coordinates, with no map
  • Your technical director’s name, profession and council registration number
  • Their certificate of medical fitness, less than three months old
  • Your clinical waste disposal contract, and your insurance certificate
  • Availability for the panel’s visit: it is required, and you are given at least ten working days’ notice

If the answer is no

The decision and the panel’s report are notified to you together. An appeal may be made to the minister responsible for health within two months, and then to the administrative court. The panel’s opinion does not bind the administration; where the decision departs from it, it says why.
